PRIVACY POLICY

Bisqit is committed to protecting its readers’ privacy.  This policy outlines the collection, handling, use and disclosure of information of Bisqit’s users who register for the Bisqit site through a computer or mobile device.

Children’s Privacy

Bisqit is not directed to children under the age of 13.  If you are under 13 years of age, you are not allowed to register for Bisqit. We never knowingly register accounts to, or collect personal information from, persons under the age of 13.  If we learn that we have any information or content from anyone under the age of 13, we will delete that information immediately.

Kinds of Information Collected and How Used or Shared

General

Information is collected by creating an account, your voluntary posts and comments (including chat and messaging) on your profile or the profile of others, your communications to Bisqit, other social networking sites to which you link or provide access to Bisqit, and the other methods described in the “Aggregate Information” section of this policy.

Personally identifiable information

We never share personally identifiable information, however collected, with third parties, with three exceptions: (1) if Bisqit has a good faith belief it must do so to meet a legal requirement, such as pursuant to a subpoena or other judicial or administrative order; (2) if Bisqit receives your consent to disclosure of personally identifiable information or you provide access to personally identifiable information to others by granting limited permission or the public access to your profile; and (3) Bisqit sells or transfers all or part of its business that includes the Bisqit site to a party that agrees to abide by this policy.  

Aggregate information (non-personally identifiable information)

We may collect and provide aggregate information about our visitors to our advertisers, sponsors, promotional partners and affiliates, such as how many persons visited a particular page or activity, what pages or activities are visited, the average age of our visitors on the site or page, or the likes and dislikes of our visitors, but this information does not include personal information about any individual visitor. We use cookies, web beacons and other log files, like most websites. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, computer configuration, operating system, monitor or mobile device resolution, referring web site, type of devices used, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. This information isn’t linked to personally identifiable information and does not include any personal information about any individual visitor.

Sharing of Information with Partners

Online advertising for Bisqit is delivered by third-party advertising companies. These companies facilitate the delivery of ads and conduct market research, and make a cookie—a small text file that’s stored on a user’s computer—for record-keeping purposes. These cookies sometimes enable the companies to serve you ads tailored to things you have shown interest in based on your web activity. So it’s possible that if you frequently read restaurant reviews, you might see ads relating to upcoming restaurant openings. Online advertising companies generally conduct this activity in an anonymous format, with online information not combined with information that would allow for your identification.

The third-party companies that will be serving advertisements on Bisqit may include, but is not limited to, Google AdSense. If you would like more information about the collection, use and disclosure practices of these companies and want to know your options for not having this information used by these companies, click on the company names above and follow the links to the company websites.

Information You Post

Please remember that anything you post to any message boards, discussion or comment areas, or social networking services on Bisqit can be seen, collected, and used by anyone who has access to that board, area, or social networking service.  We cannot control how your postings, whether or not such postings include personally identifiable information, may be used by third parties with such access.

Links

Bisqit will contain links to other sites. Please know that Bisqit is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave Bisqit to read the privacy statements of any website that collects personally identifiable information. This policy applies solely to information collected by Bisqit.

Data Security and Back-up

Any transmission of data is at your own risk.  All information gathered through our Service is stored within database(s) operated by us or by a service provider on our behalf. We and/or our service providers secure the personally identifying information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.  However, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted, despite any technological precautions we may take, while being transmitted to us over the Internet because no data transmission over the Internet can be guaranteed to be 100% secure.  Bisqit accounts are backed up regularly. If a user changes the information on her or his account, Bisqit’s stored data backups may include the user’s original information. If you email anyone at Bisqit, a record of the addresses and correspondence will continue to exist. We save this information so that we can respond to you and have a record of that correspondence.

Opting in/Opting Out  (including California resident rights)

If you register with Bisqit, you will have the opportunity to review or update the information you have provided us at any time.  You also have the option of deleting all information except for your email address.  If you would like to completely deactivate your account, please contact us at contact@bisqit.com.  Please note, however, that if you deactivate your account, you will not receive any communications from us.  Also, even if you deactivate your account, you still need to go through a separate process to unsubscribe from any alerts you previously signed up to receive and, if you established your account via another social networking site, you will have to manually remove Bisqit from your account via such social networking service to deactivate it completely.  You can unsubscribe from these alerts by using the “STOP” function within those messages.  You agree that, subject to applicable law, we may use your information to contact you for customer service, to inform you of important changes or additions to Bisqit or the services offered over Bisqit and to send you notices or any communications relevant to your use of Bisqit.

If you have submitted your information on a page provided in conjunction with one of our service providers, the information you submit may be jointly maintained by us and the service provider. If you decide to opt out of using Bisqit, you may also need to contact the service provider separately to request the service provider to remove your information from its database.  To manage the information we may receive about you from another social networking service, you will need to follow the instructions at that site for updating your information and changing your privacy settings. You can manage certain aspects of information collection and use by going to the settings of your (mobile) device and reviewing the permissions of each application. 

California law allows California residents, once a year and free of charge, to request information about certain types of personal information (if any) that a business has disclosed to third parties for their direct marketing purposes in the prior calendar year.  However, under the law, we are not required to provide this information as long as we: (1) notify you that you have the right to prevent disclosure of personal information; and (2) provide you with a cost-free means to exercise that right.  Accordingly, we require California residents to opt-in to activities where we would share their personal information with third parties for those third parties’ direct marketing purposes. If you are a California resident and you would like to prevent disclosure of your personal information for use in direct marketing by a third party, do not opt-in to participate in these activities. If you are a California resident, and you have opted in to one of these activities, but you later decide that you would like to prevent our disclosure of your personal information to third parties for their direct marketing purposes, please write to us at: contact@bisqit.com.

Changes to our Privacy Policy

We may periodically modify, alter, or update this Privacy Policy. We will alert readers to any material changes to this policy by posting the revised information here. PLEASE READ THIS AGREEMENT CAREFULLY AND THE RELATED PRIVACY POLICY!

 

Please read the following Terms of Use before using Bisqit site (the “Site”). By accessing this Site, which is owned and operated by Bisqit, LLC (“Bisqit,” “we,” or “us”), or portions thereof through another social networking site, you agree to be bound by these Terms of Use.  If you don’t agree to these Terms of Use, please don’t use this Site. Every time you use the Site, the Terms of Use that are current at that time will apply.

We reserve the right to deny access to the Site or any portion of it to anyone who violates these Terms of Use, or who, in our judgment, interferes with the ability of others to enjoy the Site or who infringe the rights of others or harass others.

Creating an Account and Ownership

A user must be at least 13 years old to register for Bisqit. For more on age restrictions, please read the Site’s Privacy Policy.  In order to create and access a profile and post comments on Bisqit you must first create an account with a username, password, email address and your name. The registration system requires that a valid email address be used to confirm the account. You’ll be informed that you should choose a username that does not include your last name and does not specify your city or your address. Bisqit asks that you use your first name only or an alias. This is for your own protection.  We reserve the right to reject or terminate any user name that, in our judgment, we deem offensive.  You will be responsible for preserving the confidentiality of your password and will notify us of any known or suspected unauthorized use of your account.  You agree that the information you supply during the registration process will be accurate and complete and that you will not register under the name of, nor attempt to use the Site under the name of, another person.  Notwithstanding anything to the contrary herein, you acknowledge and agree that you shall have no ownership or other property interest in an account, and you further acknowledge and agree that all rights in and to an account are and shall forever be owned by and inure to the benefit of us. Generally, accounts created with us will be considered active until we receive a user request to deactivate or delete them; however, we reserve the right to terminate any account that has been inactive for 180 days.

Access to the Site

You must provide all equipment and software necessary to connect to the Site, including, but not limited to, a mobile device that is suitable to connect with and use the Site, in cases where the Site offers a mobile component.  You are responsible for any fees, including internet connection or mobile fees that you incur when accessing the Site.

Privacy

We respect the privacy of users of our Site.  Please take a moment to review our Privacy Policy.

Intellectual Property

The data and materials on the Site, except User Submissions (as defined below), as well as the selection, organization, coordination, compilation and overall look and feel of the Site (collectively, the “Content”) are the intellectual property of Bisqit, our licensors and our contributors. The Content is protected by copyright and other intellectual property laws and all ownership rights remain with us, our licensors or our contributors, as the case may be. We don't want anyone to be confused as to which materials and services are provided by us and which aren't. You may not use any trademark or service mark appearing on this Site without the prior written consent of the owner of the mark. BISQIT is a registered trademark and BISQ is an unregistered trademark of Bisqit, LLC in the United States of America.

User Comments

No commenter shall use their last name when choosing a display name – use your first name or an alias. Do not enter your street address. Users should include no information that makes them publicly identifiable.  Comments may be reviewed by Bisqit, and we reserve the right to refuse comments and to remove comment accounts entirely at our discretion, including, but not limited to, for alleged violation of these Terms of Use.

 

User Submissions

Bisqit may permit the submission of communications in any form or media (whether by e-mail, chat, messaging, and other methods), including images, video, audio, comments, and text (“User Submissions”) and the hosting, sharing, and/or publishing of such User Submissions. Please follow Bisqit’s rules when both commenting and submitting—no last names, no addresses, no personally identifiable information. Your user submissions will go only to Bisqit and, like user comments, may be reviewed. What this means: We reserve the right to not publish your comments.

You agree that if you submit a User Submission to the Site that you shall be solely responsible for your own User Submission and the consequences of posting or publishing such. In connection with User Submissions, you affirm, represent, and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Site and these Terms of Use; and (ii) no such User Submissions are or will be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable or in violation of these Terms of Use.

You retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to Bisqit, you: (1) hereby grant Bisqit a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to display, perform, use, copy, reproduce, distribute, publish, create derivative works of, display, edit, and insert the User Submissions in connection with Bisqit’s (and our affiliates’ or successor’s) business (what this means in short: you continue to own the work, and are legally responsible for it and any and all copyright and consent issues, and Bisqit has the right to feature that submission on our site in perpetuity); (2) grant each user of the Site a non-exclusive license to access your User Submissions through the Site, and to use, copy, reproduce, distribute, publish, prepare derivative works of, display, and perform such User Submissions as permitted through the functionality of the Site and under these Terms of Use; (3) you are not entitled to any compensation for any User Submissions for any reason, unless expressly agreed to by the written consent of all parties; (4) we do not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Submissions.

We may remove any and all Content and User Submissions if properly notified that such Content or User Submission infringes on another’s intellectual property rights. We reserve the right, at our sole discretion, to remove Content and User Submissions without prior notice.

What all this means: if you send us a picture or other submission, you are agreeing that you own whatever you sent us, and have the right to distribute it. In sending it to Bisqit, you are giving us the right to feature it on our site in “perpetuity,” or “for as long as we’d like to.” And you won’t get paid money for that submission, unless you and Bisqit agree on some kind of payment in writing. Bisqit also reserves the right to take down submissions at any point.

Copyright Policy/DMCA

You may not post, modify, distribute, or reproduce in any way copyrighted or other proprietary materials without obtaining the prior written consent of the copyright owner of such materials. We may terminate a user account, deny access to the Site or service, or terminate any user who is alleged to have infringed the copyright or proprietary rights of another.  Without limiting the foregoing, if you believe that your copyright or other rights have been infringed, please provide our Designated Agent (as defined below) written notice with the following information:

·         An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other interest;

·         A description of the copyrighted work or other work that you claim has been infringed;

·         A description of where the material that you claim is infringing is located on our sites, networks or other repositories;

·         Your address, telephone number, and email address;

·         A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

·         A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

If the disputed materials were posted by a third party identifiable through reasonable efforts, we will provide reasonable notice to the third party of the charge. If the third party responds with a valid counter-notification pursuant to Sections 512(g)(2) and (3) of the Digital Millennium Copyright Act, we will provide you with a copy so that you may take any other steps you may consider appropriate.  A counter-notification shall be a written communication which contains:

1.     Your physical or electronic signature;

2.     Identification of the material removed or to which access has been disabled;

3.     A statement under penalty of perjury that you have a good faith belief that removal or disablement of the material was a mistake or that the material was misidentified; and

4.     Your name and telephone number, and a statement that you consent to the jurisdiction of the Federal District court in the judicial district where your address is located if the address is in the United States, and that you will accept service of process from the complainant submitting the notice or his/her authorized agent.

Intellectual Property Violations Other than Copyright

To notify us that you in good faith believe that content posted by a user on our website infringes your intellectual property rights (other than copyright -- in which case please see “Copyright Policy/DMCA”) or is inaccurate or unlawful, you may provide our Designated Agent (as defined above) a written notice with the following information:

2.     Identification of the material removed or to which access has been disabled;

3.     A statement under penalty of perjury that you have a good faith belief that removal or disablement of the material was a mistake or that the material was misidentified; and

4.     Your name and telephone number, and a statement that you consent to the jurisdiction of the Federal District court in the judicial district where your address is located if the address is in the United States, and that you will accept service of process from the complainant submitting the notice or his/her authorized agent.

Any assertions made by you in submitting this form are under penalty of perjury. Bisqit will process the counter-notification in accordance with its policies and procedures which remain in our sole discretion.

Non-Intellectual Property Violations of These Terms of Use

If you become aware of any content on Bisqit that you believe to be objectionable or to violate these Terms of Use, or that you believe may cause injury to yourself, Bisqit, or any third party, you should notify Bisqit of such content immediately by emailing: contact@bisqit.com.  Even if you notify Bisqit of such content that you believe to be objectionable, you agree that Bisqit will not be obligated to take any particular steps, or any steps at all, in response to your notification.  You agree that your notification under this paragraph will create no duty on our part to you or to any third party, and that we may not be held liable for any action that we take, or for our inaction, after you provide us with notification.

Links and Framing

Bisqit will contain links to and quotation of material from other sites. Please know that Bisqit is responsible for neither the content of nor the privacy practices of other sites.  We welcome links to our Site. You are free to establish a hypertext link to this Site so long as the link does not state or imply any sponsorship of your site, service, application, or mobile application by us. Without our prior written permission, you may not frame, or in-line link, any of the content of this Site, or incorporate into another website, application, mobile application, or other service any of our intellectual property. 

Specific Prohibited Uses

Without limiting the foregoing, we may, but are not obligated to do so, (i) immediately terminate your use of all or any portion of the Site and/or your right to use the Site, (ii) act in good faith to restrict access to or availability of your User Submissions, and/or (iii) .take other appropriate steps, including, without limitation, initiating or assisting in legal action, if you engage in any of the following prohibited activities:

• Uploading, posting, emailing, transmitting or otherwise making available any content or material that contains software viruses, worms or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications or other equipment, or to cause a security breach of such software, hardware or telecommunications or other equipment;

• Uploading or posting any off-topic or irrelevant material to any chat room or forum;

• Interfering with or disrupting any servers or networks used to provide the Site, or disobeying any requirements, procedures, policies or regulations of the networks we use to provide the Site;

• Violating any applicable local, state, national or international law, including, all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside;

• "Stalking" or otherwise harassing another;

• Instigating or encouraging others to commit illegal activities or cause injury or property damage to any person;

• Collecting or storing personal data about other users;

• Gaining unauthorized access to our Site, or any account, computer system, or network connected to this Site, by means such as hacking, password mining or other illicit means;

• Obtaining or attempting to obtain any materials or information through any means not intentionally made available through this Site;

•  Engaging in any act that we deem to be in conflict with the spirit or intent of the Site, including but not limited to circumventing or manipulating the terms of this Agreement, our game rules, game mechanics or policies;

•  Making improper use of our support services, including by submitting false abuse reports or using profane or abusive language in your communications with support personnel;

•  Using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third party software designed to modify or interfere with the Site or any experience therein;

•  Using the Site in order to design or assist in the design of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third party software designed to modify or interfere with the Site or any game experience therein; or

•. Attempting to gain unauthorized access to the Site, other accounts, servers or networks connected to the Site by any means other than the user interface provided by us.

Spam

We will immediately terminate any account which we believe is being used to transmit, or is otherwise connected with, any spam or other unsolicited bulk email in connection with any messaging service made available through the Site. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated, then you agree to pay us liquidated damages of $2 for each item of spam, unsolicited bulk email or private messaging transmitted from, or otherwise connected with, your account. Otherwise you agree to pay our actual damages, to the extent such actual damages can be reasonably calculated.

Information Security

As stated in our Privacy Policy, no data transmission over the Internet can be guaranteed to be 100% safe, so we can’t warrant that your information will be absolutely secure. But Bisqit has some technical, administrative, and physical safeguards in place to help protect against unauthorized access to, use or disclosure of user information.

Indemnification

You agree to indemnify and hold us and our affiliates, service providers and our licensors, and all of their respective shareholders, officers, directors, employees and agents harmless from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees, that arise out of your use of the Site, violation of these Terms of Use by you or any other person using your account, or your violation of any rights of another. We reserve the right to control defense of any action for which we are entitled to indemnification hereunder. In such event, you agree to cooperate with us, at our expense, as we may request in connection with our defense of such claim.

Suspension/Termination

Without limiting any other remedies, we may limit, suspend, terminate, modify, or delete accounts or access to the site or portions thereof if you are, or we suspect that you are, failing to comply with any of the terms of this agreement or for any actual or suspected illegal or improper use of the Site, with or without notice to you. You can lose your user name and persona as a result of account termination or limitation, as well as any benefits, privileges, earned items and purchased items associated with your use of the Site, and we are under no obligation to compensate you for any such losses or results.

Disclaimers

Use at Your Own Risk.  We provide the material available through this Site for informational purposes only. You may only use the material and the services available through this Site for your personal and non-commercial use. We try to ensure that information we post to this Site is both timely and accurate, and that the services offered are reliable. Despite our efforts, however, content or services on this Site may, from time to time, contain errors. Before you act on any information you've found on our Site, you should confirm any facts that are important to your decision.
